The following terms and conditions (these "Terms of Service"), govern your access to and use of the Peerz website, including any content, functionality and services offered on or through www.peerzapp.com (the "Site"), as well as the mobile applications released under the iOS and Android platforms (the “Apps”), by Peerz Inc.
This Site and the Apps are offered and available to users who are 18 years of age or older. If you are under 18 you may not use this Site, the Apps or any of the Peerz Inc services. By using this Site or the Apps, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site or the Apps.
Our Customer Support team is available during business hours if you have any questions regarding the Site or Terms of Service. Contacting our Customer Support team can be performed by submitting a request here.
Only registered Users may ask questions and only registered Providers may provide help on Peerz. Registration is free.
Providers have the freedom to determine how much they are going to charge per chat minute.
Users have the freedom to choose which providers they would like to engage in conversation with.
Providers need to provide at least 30 seconds free time at the beginning of every conversation. Charges may apply to the User buying paid per minute chat from the Provider, after 30 seconds, depending on the settings for each provider
Once a Conversation is started, and given the fact that Users pay Providers on a per minute basis, the Provider must not leave the chat window until the conversation is finished. Doing so will result with the Provider losing the entire revenue from that Conversation.
Leaving the Conversation and/or not being promptly responsive may impact a Provider’s reputation; Leaving the conversation and/or not being promptly responsive may also impact a Provider’s ability to receive the revenue from that Conversation.
Providers gain account statuses based on their performance and reputation. Advanced levels provide their owners with benefits, including appearances at the home page as featured profiles.
Users may not offer or accept payments using any method other than placing an order through the Site or the Apps.
Users and Peerz Inc are granted all rights for the completed conversation, having access to it’s history, as well as copyrights upon such conversations. Providers are not allowed to disclose, advertise or make public the contents of conversations they provided for Users.
Providers prepare their profiles with skills they wish to provide information / advice on.
Providers can browse questions posted by Users
Providers can offer help on subjects / questions that match their advertised skills
Each Conversation successfully completed by the provider will credit such provider’s account a net revenue of 80% of the Conversation total amount.
Peerz will credit the Provider’s account once a Conversation is completed.
If a conversation is disqualified or canceled for any reason, the funds paid will be refunded to the User’s account balance.
The Provider’s rating is calculated based on the conversation reviews posted by Users. High ratings allow Providers to obtain advanced Provider levels (see Level below). In certain cases, exceedingly low ratings may lead to the suspension of the Provider’s account.
For security concerns, Peerz may temporarily disable a Provider’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by Users, or associating multiple Provider accounts to a single withdrawal provider.
Providers are responsible for paying any direct or indirect taxes, including any Revenue tax, GST, VAT or otherwise, which may apply to them depending on residency or location. Providers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The Conversation total shown on the completed conversation page is inclusive of all such taxes and charges that may apply to the Providers.
Appointment as Limited Payment Collection Agent: Provider hereby appoints Peerz as Provider’s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from Users, and remitting those payments to Provider. Provider agrees that payment from User to Peerz shall be considered the same as payment made directly to Provider. User’s payment obligation to Provider will be satisfied upon completion of a successful Conversation. In the event that Peerz (via Payment Services Provider) does not remit any such amounts to Provider, the Provider will have recourse only against Peerz and not the User directly. Provider agrees that Peerz may describe or otherwise reflect the terms contained herein in any terms of service, receipts, disclosures, or notices including, but not limited to, receipts provided to Users that Peerz may deem necessary or prudent.
Peerz partners with Payment Services Providers for purposes of collecting Conversation-related payments from Users, transferring such payments from Users to Providers, and holding funds in connection with Account Balances. All payments services in connection with the withdrawal of funds on the Peerz platform are performed by Peerz’s Payment Services Providers.
Users may not offer direct payments to Providers using payment systems outside of the Peerz Conversation system.
Peerz retains the right to use all successfully completed conversations for platform improvement purposes.
Users deposit a minimum amount of $10 into their account to be able to start conversations with providers.
Users can have paid per minute conversations with providers until their account balance runs out
Peerz serves as User’s limited authorized payment collection agent solely for the purpose of accepting payments (via its Payment Services Provider, if applicable) from User, and remitting those payments to Provider. User’s account balance will reflect a deposit upon receipt of payment by Peerz (or its Payment Services Provider, as applicable), and Peerz (via its Payment Service Provider, as applicable) is responsible for remitting the funds to the Provider in the manner described in these Terms of Service. In the event that Peerz (via Payment Services Provider) does not remit any such amounts to Provider, the Provider will have recourse only against Peerz and not the User directly.
If you have funds in your account balance, either from your deposits or available Revenue from Conversations as a Provider, it will be automatically applied to your next completed conversation as a User.
In certain locations we may charge Users in their local currency. Users should note, however, that the Conversation local pricing is derived from converting their original US$ price and, therefore, local currency prices may change daily in accordance with exchange rates fluctuations and may include currency conversion fees.
You may not offer Providers to pay, or make payment using any method other than through the Peerz site or apps. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support here.
By using any payment method and/or providing payment details for making purchases on Peerz, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method(s); (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on Peerz; and (d) such actions do not violate any applicable law.
Users may be charged with indirect taxes (such as VAT or GST) depending on their residency, location and any applicable law, in addition to the Conversation total price shown on the Conversation page.
Users agree that they are responsible to comply with all tax requirements applicable to them, including but not limited to any obligation to deduct or withhold taxes. It is hereby clarified that all prices and fees that appear on the Site and the Apps are the net amounts that will be paid following any direct or indirect taxes, levy, withholding tax and/or deductions.
By using Peerz website or its applications, Users and Providers acknowledge that:
Users can engage in paid per minute chat conversations with providers as long as they have a minimally funded account. As of Dec 15th, 2018, the minimum amount required to start a conversation is $10
Account funds will clear as soon as the payment transaction is confirmed
Providers that complete a successful conversation will receive the funds related to the revenue for that conversation into their account balance
Once the User’s account is funded a conversation can start with any provider.
Once the conversation starts, providers must be present during the entirety of the conversation. Being absent or unresponsive may result in termination of the conversation and cancelation of the revenues
A conversation is marked as finished after the User or the provider choose to finish it.
We encourage our Users and Providers to try and settle conflicts amongst themselves. If for any reason this fails after using the Resolution Center or if you encounter non-permitted usage on the Site or the App, Users and Providers can contact Peerz’s Customer Support department for assistance, here.
Feedback reviews provided by Users while completing a conversation are an essential part of Peerz's rating system. Reviews demonstrate the User's overall experience with the Providers and their service. Users are encouraged to communicate to the Providers any concerns experienced during their active order in regards to the service provided by the Provider.
Leaving a User's feedback is a basic prerogative of a User. Feedback reviews will not be removed unless there are clear violations to our Terms of Service.
To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate conversations executed exclusively through the Peerz platform from users within our Community. Purchases arranged, determined to artificially enhance Provider ratings, or to abuse the Peerz platform with purchases from additional accounts, will result in a permanent suspension of all related accounts.
Feedback comments given by Users are publicly displayed on a Provider’s page. Users have the option not to include a comment, but still rate the service.
Providers may not solicit the removal of feedback reviews from their Users through mutual cancellations.
We encourage our Users and Providers to try and settle conflicts amongst themselves. If for any reason this fails after using the Resolution Center or if you encounter non-permitted usage on the Site or the Apps, users can contact Peerz's Customer Support department for assistance here.
Conversation cancellations can be performed on Peerz, when eligible, by Customer Support or through the Resolution Center per order.
Filing a transaction dispute or reversing a payment through your payment provider or your bank is a violation to these Terms of Service. Doing so may get your account temporarily or permanently disabled. Note: once you have filed a dispute with your payment provider, the funds will be ineligible for a refund due to our obligations towards the payment provider.
In the event that a User or Provider encounters an issue related to the service provided in a conversation, you are encouraged to use the Site's dispute resolution tools to attempt to resolve the matter.
Peerz, through its Payment Services Providers, reserves the right to cancel conversations or place funds on hold for any suspected fraudulent transactions made on the Site or the Apps.
All transfer and assignment of intellectual property to the User shall be subject to full payment for the Conversation and the conversation may not be used if payment is cancelled for any reason.
If a conversation is cancelled (for any reason), the funds paid will be refunded to the User’s Account Balance.
Peerz encourages Users and Providers to resolve service disputes mutually using the Resolution Center.
Eligibility for requests to Peerz to cancel a a conversation will be assessed by our Customer Support team based on a number of factors, including violations to our Terms of Service, general misconduct, and improper usage of the Peerz chat system.
Completed conversations may be cancelled, upon review of our Customer Support team, up to 14 days after the conversation is marked as complete. Please be advised that conversations cannot be partially canceled (i.e. we can only cancel the entire conversation when it is justified).
Conversations are not eligible to be cancelled based on the quality of service delivered by the Provider if the Provider was not absent or unresponsive. Users may rate their experience with the Provider on the conversation page, including the overall level of service quality received.
Users must use Peerz Resolution Center to address their concerns and desired resolution related to the service provided by their Provider prior to contacting Customer Support. Customer Support will not take any action against Conversations where the Users failed to inform their Provider of issues related to the Provider’s service and will allow Providers to provide a resolution first. This does not include non-permitted usage of Peerz.
Any non-permitted usage of Peerz encountered during a Conversation, after being reviewed by our Customer Support team, may result in the order being cancelled. This includes, but not limited to; harassment, unlawful behavior, or other violations to Peerz’s Terms of Service.
Peerz Customer Support will cancel conversations based on, but not limited to, the following reasons:
Refunds for credit card transactions to fund accounts are allowed up to 48 hours after the account funding.
Peerz does not automatically refund payments made for cancelled conversations back to your payment provider. Funds from conversation cancellations are returned to the Account's balance as credit and are available for future purchases on Peerz. Funds returned to your balance from cancelled conversations will not include service fees paid.
Deposit refunds, when available from the payment provider, can be performed by our Customer Support team. To prevent fraud and abuse, we limit the total amount of times users can request a payment provider refund from their account which is subject to review by our Customer Support team. Such refunds may be subject to an additional fee. If any service fees were added at the time of purchase to create a new order, the service fees from that payment will not be refunded along with your deposit.
Users and providers with any balance in their accounts of $10 or above are able to request withdrawals upon selection of the destination: Check, Bank Account wire or paypal transfer.
Peerz will charge a fee per withdrawal request. This is due to the fact that credit card operators charge a fee themselves for every deposit, and therefore Peerz are unable to provide a full amount withdrawal. If you fund your account in error, make sure you request a refund within 48h by sending an email to firstname.lastname@example.org
Withdrawals requests can take up to 7 business days to be processed.
Peerz enables people around the world to engage in paid per minute chat conversations. Services offered on Peerz reflect the diversity of an expanding economy. Members of the Peerz community communicate and engage through conversations, social media, and other communication platforms.
Peerz maintains a friendly, community spirited, and professional environment. Users should keep to that spirit while participating in any activity or extensions of Peerz. This section relates to the expected conduct users should adhere to while interacting with each other on Peerz.
To report a violation of our Terms of Service, User Misconduct, or inquiries regarding your account, please contact our Customer Support team here.
To protect our users' privacy, user identities are kept anonymous. Requesting or providing Email addresses, Skype/IM usernames, telephone numbers or any other personal contact details to communicate outside of Peerz in order to circumvent or abuse the Peerz messaging system or Peerz platform is not permitted.
Any necessary exchange of personal information required to continue a service may be exchanged within the conversation page.
Peerz does not provide any guarantee of the level of service offered to Users. You may use the dispute resolution tools provided to you in the order page.
Peerz does not provide protection for users who interact outside of the Peerz platform.
All information and file exchanges must be performed exclusively on Peerz's platform.
Rude, abusive, improper language, or violent messages will not be tolerated and may result in an account warning or the suspension/removal of your account.
Peerz is open to everyone. Discrimination against a community member based on gender, race, age, religious affiliation, sexual preference or otherwise is not acceptable and may result in the suspension/removal of your account.
Users may not submit proposals or solicit parties introduced through Peerz to contract, engage with, or pay outside of Peerz.
Users with the intention to defame competing Providers by ordering from competing services will have their reviews removed or further account status related actions determined by review by our Trust & Safety team.
Users are to refrain from spamming or soliciting previous Users or Providers to pursue removing/modifying reviews or cancelling conversations that do not align on Order Cancellation or Feedback policies.
Peerz reviews cases of payment provider chargebacks and disputes on behalf of Providers. Although results vary per case due to each chargeback reason, we work hard on resolving disputes in the Provider’s favor. If the chargeback case allows, Peerz (or one of Peerz’s Payment Services Providers) will return parts or full revenue back to Providers.
Users may report Conversations to Customer Support that may be in violation of Peerz’s Terms of Service.
Providers warrant that any content included in their Conversations shall be original work conceived by the Provider and shall not infringe any third party rights, including, without limitation, copyrights, trademarks or service marks. In the event that certain music or stock-footage media are incorporated within the Conversations, Providers represent and warrant that they hold a valid license to use such music and/or footage and to include them in the Conversation.
Peerz will respond to clear and complete notices of alleged copyright or trademark infringement. Our Intellectual Property claims procedures can be reviewed here.
Users and Providers may receive a warning to their account for violations of our Terms of Service or any user misconduct reported to our Trust and Safety team. A warning will be sent to the user's email address and will be displayed for such user on the Site or Apps. Warnings do not limit account activity, but can lead to your account losing Provider statuses or becoming permanently disabled based on the severity of the violation.
Inappropriate Behavior & Language - Communication on Peerz should be friendly, constructive, and professional. Peerz condemns bullying, harassment, and hate speech towards others. We allow users a medium for which messages are exchanged between individuals, and a system to rate conversations
Phishing and Spam
Peerz takes the matter its members’ security seriously. Any attempts to publish or send malicious content with the intent to compromise another member’s account or computer environment is strictly prohibited. Please respect our members privacy by not contacting them with offers, questions, suggestions or anything which is not directly related to their Conversations or Skills
Privacy & Identity
You may not publish or post other people's private and confidential information. Any exchange of personal information required for the completion of a conversation must be provided in the conversation page. Providers further confirm that whatever information they receive from the User, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the service to the User. Any users or providers who engage and communicate off of Peerz will not be protected by our Terms of Service.
Authentic Peerz Profile
You may not create a false identity on Peerz, misrepresent your identity, create a Peerz profile for anyone other than yourself (a real person), or use or attempt to use another user’s account or information; Your profile information, including your description, skills, location, etc., while may be kept anonymous, must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. Peerz reserves the right to require users to go through a verification process in order to use the Site or Apps (whether by using ID, phone, camera, etc.).
Intellectual Property Claims
Peerz will respond to clear and complete notices of alleged copyright or trademark infringement, and/or violation of third party’s terms of service.
Fraud / Unlawful Use
You may not use Peerz for any unlawful purposes or to conduct illegal activities.
Abuse and Spam
To prevent fraud and abuse, users are limited to one active account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the Peerz community will be disabled. Mass account creation may result in disabling of all related accounts. Note: any violations to Peerz’s Terms of Service is cause for permanent suspension of all accounts.
We do not tolerate users who engage in targeted abuse or harassment towards other users on Peerz. This includes creating new multiple accounts to harass members through our message or converstion system.
You may not buy or sell Peerz accounts.
Peerz reserves the right to put any account on hold or permanently disable accounts due to breach of these Terms of Service or due to any illegal or inappropriate use of the Site or services.
Violation of Peerz’s Terms of Service may get your account disabled permanently.
Users or Providers with disabled accounts will not be able to sell or provide services on Peerz.
Users or Providers who have violated our Terms of Service and had their account disabled may contact our Customer Support team for more information surrounding the violation and status of the account.
Users and Providers have the option to enable account Security features to protect their account from any unauthorized usage.
Users and Providers must be able to verify their account ownership through Customer Support by providing materials that prove ownership of that account.
Providers will be able to withdraw their revenues from disabled accounts after a safety period of 90 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account and subject to Peerz’s approval.
Disputes should be handled using Peerz’s dispute resolution tools ('Resolution Center' on the conversation page) or by contacting Peerz Customer Support.
Peerz may make changes to its Terms of Service from time to time. When these changes are made, Peerz will make a new copy of the terms of service available on this page.
You understand and agree that if you use Peerz after the date on which the Terms of Service have changed, Peerz will treat your use as acceptance of the updated Terms of Service.
User Generated Content ("UGC") refers to the content added by users as opposed to content created by the Site. All content uploaded to Peerz by our users (Users and Providers) is User Generated Content. Peerz does not check user uploaded/created content for appropriateness, violations of copyright, trademarks, other rights or violations. We invite everyone to report violations together with proof of ownership as appropriate. Reported violating content may be removed or disabled.
Furthermore, Peerz is not responsible for the content, quality or the level of service provided by the Providers (even if they are Featured Providers, Top Rated Providers or otherwise). We provide no warranty with respect to the Conversations, their quality, and any communications between Users and Providers. We encourage users to take advantage of our rating system, our community and common sense in choosing appropriate Help offers.
By offering a service, the Provider undertakes that he/she has sufficient permissions, rights and/or licenses to provide, sell or resell the service that is offered on Peerz. Providers advertising their Skills online must comply with laws and terms of service of the advertising platform or relevant website used to advertise. Failing to do so may result in removal of the Profile and may lead to the suspension of Provider's account.
Ownership and limitations: Unless clearly stated otherwise on the Provider’s Profile page/description, when the conversation is completed, and subject to payment, the User is granted all intellectual property rights, including but not limited to, copyrights for the information / conversation delivered from the Provider, and the Provider waives any and all moral rights therein. The conversation transcript shall be considered work-for-hire under the U.S. Copyright Act. In the event the conversation transcript does not meet the requirements of work-for-hire or when US Copyright Act does not apply, the Provider expressly agrees to assign to User the copyright in the delivered work. All transfer and assignment of intellectual property to User shall be subject to full payment for the Conversation and the conversation transcript may not be used if payment is cancelled for any reason. This means that if you hire a Provider and retain the conversation transcript for personal or commercial use, you will own all rights you require for such use.
Providers further confirm that whatever information they receive from the User, which is not public domain, shall be kept confidential and shall not be shared or used for any purpose whatsoever other than for the delivery of the ordered conversation service to the User.
Furthermore, users (both Users and Providers) agree that unless they explicitly indicate otherwise, the content users and providers voluntarily create/upload to Peerz, including texts, photos, videos, usernames, user photos, user videos and any other information, including the display of delivered work, may be used by Peerz for no consideration for marketing and/or other purposes such as platform improvements, machine learning, etc.
By completing a conversation and finalizing the payment for such, a “Commercial Use License” shall be granted to the User by the Provider, and the Provider grants the User a perpetual, exclusive, non-transferable, worldwide license to use the conversation transcript for Permitted Commercial Purposes. All intellectual property rights of the purchased delivery are hereby assigned to the User. “Permitted Commercial Purposes” means any business related use, such as (by way of example) advertising, promotion, creating web pages, integration into product, software or other business related tools etc., and strictly excludes any illegal, immoral or defamatory purpose. This License is subject to Peerz’s Terms of Service. There is no warranty, express or implied, with the purchase of this service, including with respect to fitness for a particular purpose. Neither the Provider nor Peerz will be liable for any claims, or incidental, consequential or other damages arising out of this license, the delivery or your use of the delivery.
YOUR USE OF THE SITE, APPLICATIONS, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
